Terms of Service

These Terms of Service are concluded between the holder of an account (the “Customer”) who initiates the creation of an ANEP Mobile Workspace, the natural persons (the “Users”) invited to use the ANEP Mobile Workspace created by the Customer and ANEP SAS.

BY CLICKING ON THE BOX, “I ACCEPT THE GENERAL TERMS AND CONDITIONS OF USE", YOU GIVE, IN YOUR CAPACITY AS CUSTOMER/USER YOUR EXPRESS CONSENT TO BE BOUND BY THESE TERMS OF SERVICE (ToS) THAT GOVERN YOUR USE OF THE SERVICES OF THE ANEP MOBILE APPLICATION.

 IF YOU ARE ENTERING INTO THIS CONTRACT ON BEHALF OF A LEGAL PERSON, YOU CERTIFY THAT YOU HAVE THE CAPACITY AND THE POWER TO COMMIT THIS PERSON TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS, “CUSTOMER”, “USER”, “YOU” OR "YOUR" WILL REFER TO THE SAID LEGAL PERSON.

“Customer” means the natural or legal person who signs up to and activates the Service provided by ANEP SAS and is responsible for use of it by its Services.
“User” means the natural person (i.e. the Customer’s employee or that of a third party), who, following an invitation from the Customer, registers a User account and obtains access to the Services.  

1. Acceptance of the terms of service

Access to and use of the ANEP Mobile application are subject to acceptance and respect of these Terms of Service (ToS).

ANEP SAS reserves the right to change, at any time and without notice, the ANEP Mobile application and the services as well as these ToS, in particular to adapt them to changes to the application through the provision of new features or the removal or modification of existing features.

The user is therefore advised to refer to the latest version of the ToS before undertaking any navigation, accessible at any time on the website. In the event of a disagreement with the ToS, no use of the ANEP Mobile application may be made by the user.

2. Management, access and navigation

ANEP SAS uses the technical solutions available to it to enable access to the website 24/7. It may nevertheless at any time suspend, restrict a specific category of users or interrupt access to the website or to certain pages of it to make updates, changes to its content or any other action deemed necessary for the smooth functioning of the application.

Logging onto, navigating with and using the ANEP Mobile application is deemed to be unreserved acceptance of these Terms of Service.

3. Responsibility

ANEP SAS is only responsible for the content that it has published itself.

The Customer’s and User’s obligations

The Customer guarantees that all the information provided related to its contact details and its users is correct and it undertakes to update it on a regular basis.

The Customer is entitled to assign administrative responsibility for the ANEP mobile workspace to a designated User. The designated User will, in this case, have the same monitoring obligations as the Customer. 

 The User is entirely responsible for the use they make of the ANEP Mobile Services. In this regard, it is their responsibility to ensure that the ANEP Mobile Services are used properly. Any Content uploaded onto the server, transferred, publicly published, processed or entered in the ANEP Mobile Services by the User is under their sole responsibility.

The Customer alone is responsible for managing their ANEP Mobile Workspace. 

The User undertakes to use ANEP Mobile Services in such a way that this use will not be able to prevent, or interrupt remote alarm or remote surveillance communications to the services concerned and thereby ensure the safety of the users. (elevator, garage door, escalator, emergency call terminal).

The Customer undertakes not to provide access to the Services to anyone other than those Users with the competence to use the ANEP Mobile Service. 

4- Ownership

4.1 Access to the ANEP Mobile Services is granted as a license and is not sold. ANEP SAS owns all the ownership titles and intellectual property rights as well as the technical solutions, or has an exclusive right to use them. These intellectual property rights and these technical solutions may only be used by the Customer in the way set out in these ToS. Under no circumstances may the Customer or a Third Party acquire intellectual property rights in relation to the Services, to the software or to the technical solutions used by the Services, or to any trademark or name belonging to or used by ANEP SAS.
4.2 Any Content uploaded onto the server, transferred, publicly published, processed or entered into the Services by the User remains the User’s exclusive property or that of its legal owner. ANEP SAS disclaims all liability in relation to this Content.

5. Assistance to the Customer

ANEP SAS provides assistance to the Customer by email and phone regarding Customers’ questions. This assistance is provided by SAS ANEP, Monday - Friday, (with the exception of public holidays in France) during the normal working hours of ANEP SAS (8.30 am - 4.30 pm, Central European time), in a reasonable way.
Requests and/or notifications of errors must be submitted to SAS ANEP by email or by phone in accordance with the contact information available on the ANEPstore.com website
